Before advertising or applying
Confirm the property and proposed arrangement are covered by the rules you intend to use. Review advertising, minimum-standard, discrimination, application-information and privacy requirements before collecting applicant data or accepting money.
- Identify whether the offer is a whole property, room, boarding or another accommodation type.
- Check the current advertising and application rules.
- Prepare an accurate description and a proportionate information-collection process.
- Establish and follow the jurisdiction’s required retention, destruction and de-identification timeframes for application information.
Starting the tenancy
After confirming the legal classification, use the current prescribed agreement and information documents for that arrangement. For a standard residential tenancy, use the current NSW standard residential tenancy agreement and required information statement. Complete the entry condition process carefully and follow the official bond-lodgement pathway rather than holding bond money informally.
- Use the current agreement and required disclosures for the confirmed arrangement.
- Record the starting condition with both parties able to contribute.
- Follow Rental Bonds Online and NSW Fair Trading instructions for any bond.
- Give contact, payment, repair and emergency information in writing.
During the tenancy
Keep a reliable record of rent, communication, access, repairs and agreed changes. Entry, rent increases, repairs, safety obligations and utility charges are jurisdiction-specific; check the current official rule before sending a notice or charging an amount.
- Provide a clear way to report urgent and routine repairs.
- Use the required notice, reason, method and time period before entry.
- Document agreed changes rather than relying on a conversation.
- Treat personal information and property-access evidence as sensitive.
Ending or changing the arrangement
Do not assume a fixed-term end date automatically authorises a particular termination process. Check the permitted grounds, evidence, form, service method and notice period. If the parties cannot resolve a dispute, review NSW Fair Trading and NCAT guidance and the authority's dispute pathway.
